House2u has 4 model rental agreements with which we work:: – Model A: the indefinite rental agreement; (with a minimum of 12 months);
– Model B: the fixed-term lease with a maximum term of 24 months. We also use this model for short-stay rentals.
– Model C: the rental agreement under a Diplomacy Clause (landlord will move into the property himself after the rental period ends);
– Model D: rental under the Leegstandwet (temporary rental of a property during the period the property is for sale).

Renting to a residential group does not require a permit in Rotterdam. As a landlord, it is possible to terminate the lease with good reason(s). Notification of termination must be made by registered letter or bailiff’s writ stating the reason(s) and notice period. To the minimum of 3 months, 1 month is added for each year the tenant has occupied the property, with a maximum of 6 months total.

Is the maximum rent of your home according to the points higher than €879.66 (amount 2024)? If so, your property falls under the definition of “vrijesectorwoninging”. You may then set your own rental price. Non-self-contained housing, in Dutch “Onzelfstandige woningen” (such as bedroom rental) does not fall under the defintion of “vrije sector woningen”. These properties are deregulated.(In Dutch geliberaliseerd) The housing valuation system, also known as points system, does not apply and the Rent Commission is not authorized to rule on the price of rent.

However, the tenant always retains the right within six months, after the start of the lease, to request the Rent Commission to determine how many points the property is worth. If the Rent Commission determines that the property is worth less than 141 points, the point system will still apply. From the start of the rental agreement, the rent will be set by the Rent Commission at the rent corresponding to the point number of the property.

A different deadline applies to a fixed-term rental agreement, Model B. With that agreement, the tenant has up to six months after the expiration of the rental agreement to initiate proceedings before the Rent Commission to review the initial rent.

If the property is valued below 141 points and the tenant fails to go to the Rent Commission within the deadline referred to above, the property is liberalized for this tenant if the agreed rent is above the liberalization limit.

Some insurance companies do not allow temporary rental. It is important to check the terms of your insurance in advance.
For furnished rentals, you will need inventory insurance. A household insurance policy is usually not valid when renting out, because it is purchased in your own name.

Since July 1, 2021, the rules for renting rooms in Rotterdam have become stricter. You now need a permit if you want to live with 2 or more people.
